Terms of Service

These Terms of Service ("Terms") govern your access to and use of PulseRank (the "Service"), operated by PulseRank ("we", "us", "our"). By creating an account, running a scan, or otherwise using the Service, you agree to be bound by these Terms. If you don't agree, please don't use the Service.

1. What PulseRank does

PulseRank sends real prompts to third-party AI platforms (including but not limited to ChatGPT, Claude, Gemini, Perplexity, and Llama) and analyses their responses to report whether, where, and how your brand is mentioned. Scores, sentiment labels, and rankings are automated estimates derived from that analysis — they are directional signals, not guarantees, and can change as AI platforms update their models.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You're responsible for the accuracy of the information you provide and for all activity that happens under your account. Use a strong, unique password and tell us immediately at our contact page if you believe your account has been compromised.

3. Free scans

We offer a limited free AI-visibility scan, one per email address, without requiring payment information. We may change, limit, or discontinue the free scan at any time, including to prevent abuse (for example, automated or bulk submissions).

4. Subscriptions and billing

Paid plans (currently Pro and Team) are billed monthly in advance through PayPal. By subscribing, you authorise PulseRank to charge your chosen PayPal account on a recurring basis until you cancel.

• Cancellation. You can cancel at any time from your account settings or your PayPal account. Cancelling stops future billing; you keep access to paid features until the end of the billing period you already paid for.
• Refunds. We offer a 7-day refund window from your first payment on a plan. To request a refund, contact us within 7 days of that charge. Refunds outside this window are granted at our discretion.
• Plan changes. Upgrades take effect immediately and are billed pro-rata or at the next cycle depending on the payment method's capabilities. Downgrades take effect at the end of the current billing period.
• Failed payments. If a renewal payment fails, we may retry it and will attempt to notify you by email. Continued failure may result in suspension of paid features until payment succeeds or the account is downgraded to the Free plan.

5. Acceptable use

You agree not to:

• use PulseRank to harass, defame, or spread misinformation about any brand, person, or organisation;
• attempt to reverse engineer, scrape at scale, or interfere with the Service's normal operation;
• use automated means to create multiple free-scan accounts to bypass usage limits;
• share paid-plan account access with people or organisations who haven't agreed to these Terms; or
• use the Service in violation of any applicable law or the terms of service of the AI platforms we query on your behalf.

We may suspend or terminate accounts that violate this section, with or without notice, depending on severity.

6. Third-party AI platforms

PulseRank is an independent product and is not affiliated with, endorsed by, or sponsored by OpenAI, Anthropic, Google, Perplexity, Meta, or any other AI provider referenced on the Service. We have no control over how those platforms answer any given prompt, and their outputs can change without notice. We are not responsible for the content of third-party AI responses.

7. Your content and data

You retain ownership of the brand information, keywords, and competitor lists you submit to PulseRank. You grant us a licence to use that information solely to operate the Service on your behalf — running scans, generating reports, and improving the product. 8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that any scan result reflects the totality of how AI platforms discuss your brand, or that acting on our recommendations will improve your visibility.

9. Limitation of liability

To the maximum extent permitted by law, PulseRank and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the Service — even if we've been advised of the possibility of such damages. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose.

10. Termination

You may stop using the Service and delete your account at any time from Settings → Account. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service — in the latter case, we'll give you reasonable notice where practical.

11. Changes to these Terms

We may update these Terms from time to time. For material changes, we'll notify you by email or with a notice inside the app before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which PulseRank is registered to do business, without regard to conflict-of-law principles, unless otherwise required by mandatory consumer-protection law in your country of residence.
